Emerald Performance Materials, LLC and its affiliates (collectively, “Emerald”) respect your privacy and we want you to understand how we intend to Personal Information (defined below). We developed this Privacy Policy pursuant to applicable law regarding the collection and use of Personal Information in those jurisdictions where we do business. This Privacy Policy outlines the types of Personal Information we gather when you (“you” or “User”) use the Emerald website located at, all pages residing at this domain and all websites owned and operated by Emerald (collectively, the “Website”), how we use that information, as well as some of the steps we take to safeguard it. We urge you to read the Privacy Policy in its entirety and hope it will help you make an informed decision about sharing your Personal Information with us.



a. Accountability

Emerald is responsible for your Personal Information under its control. Emerald has appointed an officer who is accountable for Emerald’s compliance with this Privacy Policy. The privacy officer can be reached by regular mail at 1499 SE Tech Center Pl, Ste 300, Vancouver, WA 98683, USA.

b. Identifying Purposes

“Personal Information” is information that individually identifies you, such as your name, company name, physical address, phone numbers, e-mail address and any other information that would allow someone to identify or contact you. Emerald may ask for your Personal Information so that it can understand your interests, determine if Emerald’s products and services meet your needs, inform you about its products and services that it believes may be of interest to you, and/or to comply with the law. Of course, you may choose not to provide Emerald with Personal Information when you visit the Website. However, this choice may prevent Emerald from providing you with the product, service or information you requested or that could be offered to you. Our server does not automatically record Personal Information. Such information can become known to Emerald only when you voluntarily submit it.

c. Consent

Your knowledge and consent are required for the collection, use, or disclosure of your Personal Information. No Personal Information is collected without your express consent.

d. Limiting Collection

Emerald only collects the information that it needs in order to deliver products, services and information to you.

Emerald does not use or disclose your Personal Information for purposes other than those for which it was collected or as set forth in this Privacy Policy, except as otherwise set forth in this Privacy Policy under the heading “Limits of Confidentiality,” or as required by law. Your Personal Information is retained only as long as necessary for the fulfillment of those purposes or as required by law.

f. Accuracy

Your Personal Information is kept as accurately and completely as is necessary for the purposes for which it is to be used. You have the right to update, modify, amend or correct errors in your Personal Information by contacting Emerald.

g. Safeguards

Emerald protects your Personal Information by using safeguards that are appropriate to the sensitivity of the information. Emerald has made a substantial investment in its server, database, backup and firewall technologies to protect our information assets, including the confidentiality of information collected about Users. These technologies are deployed as part of a sophisticated security architecture and protocol. Each of our employees who has access to your Personal Information is informed about our Privacy Policy and procedures for protecting Personal Information.

You should also do your part in protecting your information. Your user name and password are confidential and we recommend that you not divulge them to anyone. Unfortunately, neither Emerald’s network nor data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect User’s information, Emerald cannot ensure or warrant the security of member information. Thus, any information a User transmits to us is done so at the User’s own risk. Once we receive User information, we undertake substantial efforts to protect the confidentiality of this information consistent with this Policy.

h. Openness and Access

Emerald will make its complete policies and practices relating to the management of your Personal Information readily available to you. Upon request in writing, either by e-mail or letter, you will be informed of the existence, use or disclosure of your Personal Information and you will be given access to that information. Emerald will assist any customer who informs us that they need assistance in preparing a request concerning Personal Information. You may also challenge, in writing either by e-mail or letter, the accuracy and completeness of the information and have it amended as appropriate, or request that Emerald delete or correct any Personal Information contained in your file.



a. Collection of Personal Information

We obtain and retain only the Personal Information that Users choose to provide to us. When you use any e-mail form on the Website, we may collect Personal Information from you and offer you an area to enter comments or questions.

b. Collection of Non-Personal Aggregated Website Usage Statistics

Emerald collects and logs certain non-personally identifying information which a User’s browser makes available whenever a User visits the Website. This information includes a User’s Internet Protocol (“IP”) address (a unique number assigned to every computer on the Internet), browser type, browser language, as well as the date and time of a User’s visit. This information does not include a User’s Personal Information. We use this information to administer, operate, develop, and improve the Website.

We may also track and store information in the aggregate as it relates to Users’ movement within the Website such as the pages from which the Users were referred, entry and exit points for the Website, search terms, pages Users visit, page views/impressions, access times, domain names and browser types. None of this information is linked to a User’s Personal Information.

c. Cookies and other Automated Processes

We use cookies in connection with the Website. These are small text files that are stored on a User’s computer and record data about a User’s visit. Cookies assist web surfing by saving visitor preferences and other information. In general, we use cookies to collect information so that we can determine how to improve our Website and services by seeing which areas and features are most popular, to personalize the Website, to improve a User’s experience on our Website, and to complete transactions a User has requested. We reserve the right to use “persistent cookies” which are retained after a visit as well as “session cookies” which expire when a User closes a User’s browser.

None of this information is linked to a User’s Personal Information.



a. Data Handling

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online which is in our possession or under our control. We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data which is in our possession or under our control. We restrict access to Users’ Personal Information to employees who need to know that information in order to perform their jobs and provide services to Users.

b. Confidentiality

Except as set forth under the “Limits of Confidentiality” section below, or as otherwise set forth in this Privacy Policy, Emerald will not provide Personal Information about a User to third parties.

c. Limits of Confidentiality

If you choose to share your Personal Information with us we may use it for the purposes of sending you requested information as well as occasional offers, announcement, bulletins and other similar purposes. We also will not give, rent, loan, or otherwise make available your Personal Information to third parties except in the limited circumstances described in this “Limits of Confidentiality” section, or with your consent.

We may share such information in any of the following limited circumstances:

Marketing. As part of its day-to-day business activities, Emerald may share with third parties certain non-personally identifying log information your browser makes available whenever you visit our Website.

Transactions with Emerald. We may provide your Personal Information to trusted businesses or persons (“Business Partners”) for the sole purpose of processing or storing personally identifying information on our behalf. These Business Partners include website developers, internet service providers, as well as other third parties we use to assist us in our mission of proving you with Emerald products and services. When we do disclose your information to others, it is subject to agreements that require those parties to process such information only on our instructions, in compliance with this Privacy Policy, and in an appropriate confidential and secure manner.

Security. Due to the existing legal, regulatory and security environment, Emerald may disclose aggregate level and/or Personal Information about its Users to protect the rights, property or safety of Emerald, our customers, or the public.

Sale or Transfer of Business. We may sell or otherwise transfer such information to a successor of Emerald, or any subsidiary or division of Emerald in connection with an asset sale, acquisition, merger, consolidation, divestiture, stock sale, purchase of part or all of the assets of the business, or other corporate transaction, or by way of assignment (whether by operation of law or otherwise) in connection with any such or similar transaction or in connection with the administration of a bankruptcy estate. In the case of such event, the Personal Information will become the property of the successor and will be subject to the successor’s Privacy Policy should they have one.

Court Order, Fraud or Emergency. Emerald may disclose aggregate and/or Personal Information about Users to protect the rights, property or safety of Emerald, our Users or the public. We may disclose Personal Information if required to do so by court order, subpoena, request by federal, state, local or foreign law enforcement, or other legal proceeding. We may also disclose Personal Information to protect our Users from fraudulent, abusive or unlawful use of our Website, or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.

User Instructions. If a User of the Website voluntarily contacts us because the User is having a problem with the Website or Emerald, we may need to utilize information provided by the User in the course of investigating and attempting to resolve the problem.

Links to Other Websites. On occasion, the Websites is connected by “hyperlinks” to other companies’ websites. Emerald is not responsible in any way for the privacy practices of other websites and suggests that you review the privacy policies of those other companies’ websites before using them.



a. Accessing Personal Information

You have the right to request information about the existence, use and disclosure of your Personal Information and to challenge the accuracy and completeness of your Personal Information, and to have your Personal Information amended where inaccurate or deleted from Emerald’s database. To do so, simply contact Emerald at the address below. On each e-mail you receive from Emerald, you will be given the opportunity to change, modify or delete information which you have previously provided to Emerald and you will also be given the opportunity to unsubscribe, thereby removing your e-mail address permanently from our mailing list.

c. Opting-out

Even after you have granted Emerald your consent to collect Personal Information, you may opt-out of having your Personal Information collected by contacting us by e-mail or regular mail. Please note that in order to fulfill certain obligations, we may need to continue sending you notices or other important information concerning any orders or services you request. If you wish not to receive targeted marketing e-mail from Emerald and wish not to have their information shared with third parties as set forth in this policy, you may contact us at the address below to terminate your registration.



Please note this Privacy Policy is subject to change from time to time without specific notice. We expect most such changes to be minor, but there may be changes that are more significant. Regardless, we will post those changes on this page and, if the changes are significant, we will also provide a more prominent notice. Each version will be noted at the top of the page. Prior versions of this Privacy Policy will be kept in an archive for you to view for a reasonable period of time. There are no prior versions in the archive at this time.
